Meta-analyses establish medium-to-large executive-function deficits in FASD (Khoury et al., 2015), the strongest/most consistent planning and set-shifting deficits relative to controls and even ADHD (Kingdon et al., 2016), and adaptive-functioning deficits independent of IQ (Kautz-Turnbull & Petrenko, 2021). Forensic analysis argues these impair mens-rea-relevant capacities and, following Atkins v. Virginia's culpability logic, diminish blameworthiness (Novick Brown et al., 2021); a systematic review of justice-involved samples cautions that confounding limits firm forensic conclusions (Khalifa et al., 2021).
