The operative claimBlack children are substantially overrepresented in the U.S. child-welfare system — in foster care at roughly twice their share of the child population — but the cause is genuinely contested: quasi-random-assignment evidence from one large system found Black children 55% more likely to be placed than white children with identical potential for future maltreatment, while national and state benchmark studies find reporting disparities no larger than underlying poverty-and-harm disparities and equal-or-lower substantiation and placement odds after a report, locating the disparity upstream in structural socioeconomic conditions.
Everyone agrees Black children enter and remain in the child-welfare system far beyond their population share, and that family separation is itself consequential — so the stakes of the question are not disputed. The mechanism is: one research tradition, now armed with quasi-random-assignment causal methods, documents unwarranted disparity in placement decisions holding risk constant; another, using national and state benchmarks, finds the disparity concentrated at the reporting stage and fully traceable to socioeconomic conditions, with post-report decisions showing no anti-Black differential. These findings are not strictly contradictory — they concern different decision points and systems — and the field's honest state is that both structural need and within-system treatment likely contribute, in proportions that vary by place and stage.
Applies to U.S. child protective services decision-making (reporting, screening, substantiation, placement) and foster-care representation, 2005–present. The overrepresentation itself is undisputed; the split concerns mechanism — differential treatment within CPS versus differential exposure to poverty-linked risk before CPS — and the strongest evidence on each side uses different designs, systems, and outcome definitions, so both may be true in different places and at different decision points.

Leveraging quasi-random assignment of hotline screeners and investigators, calls involving Black children were 55% more likely to result in foster care placement than calls involving white children with the SAME potential for future maltreatment in the home — the definition of unwarranted disparity. Call screeners accounted for up to 19% of the unwarranted disparity, investigators for the remainder; disparity concentrated in cases with potential for future maltreatment, suggesting white children may be harmed by "under-placement" in high-risk situations. The most credibly causal evidence of differential treatment in U.S. child protection.

Black children are represented in foster care at a rate nearly double their proportion of the general child population — the descriptive core no one disputes. The review organizes the causal accounts: influences external to child welfare (disproportionate need rooted in structural disadvantage) and internal to it (decision-making disparities), arguing both trace to structural and institutional racism, and that disproportionate family separation itself inflicts disproportionate harm. CONFLICTING (on causes): Black-White CPS reporting disparities were LOWER than the disparities found in non-CPS risk and harm benchmarks (child poverty, infant mortality), and in recent multivariate analyses Black children were LESS likely than White children to be substantiated or placed after a report. The authors find no evidence Black children are over-reported relative to observed risks and harms, and conclude that reducing reporting disparities requires addressing the underlying conditions — the differential-need pole of the debate.

The causal QJE evidence comes from one (anonymized) large system and may not generalize; benchmark studies infer warranted disparity from proxies (poverty, infant mortality) that cannot capture case-level risk; outcome definitions (reporting vs substantiation vs placement) differ across the opposing studies, so they partly talk past each other; national administrative data lack the granularity to run the causal design everywhere; and Hispanic, Indigenous, and multiracial patterns are thinner and sometimes opposite-signed (the "Latino paradox"). Within-care experience disparities (placement disruption, non-kin placement) are more consistent than entry-mechanism findings.

Within care, non-White children did experience more placement disruptions and (for Black children) more non-kin placements.
